These Terms of Service (“Terms”) govern your access to and use of the HLH Gems website and the services described on it (together, the “Services”). The Services are operated by HLH GEMS LIMITED, a company incorporated in Hong Kong (“HLH”, “we”, “us”).

By accessing or using the Services, you agree to these Terms. Please read them with care.

1. About HLH Gems

HLH sources and sells natural coloured gemstones and offers sourcing, design and mounting, and resale services to private collectors, retail clients and trade partners. This website presents our collection and allows you to make an enquiry. Use of the website by itself creates no contract of sale, agency or advisory relationship.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services you confirm that you meet this requirement.

3. Enquiries, Viewings and Sales

Stones shown on this website are presented for information and are offered subject to availability. Every sale is concluded by a separate written agreement or invoice between you and HLH, which will set out the stone, the price, the payment terms, delivery and any applicable conditions. Where the website and a signed agreement differ, the signed agreement prevails.

• Prices, where shown, are indicative and may change without notice. Prices are quoted before shipping, insurance, import duties and taxes unless stated otherwise.

• Viewings take place at our Hong Kong office by appointment, or by video for clients abroad.

• Title to a stone passes to you only once HLH has received payment in full.

• A stone remains reserved for you only once a deposit or written confirmation has been agreed.

4. Certificates and Descriptions

Each stone is sold with a report from an independent gemmological laboratory, such as GRS, Gübelin, SSEF or GIA. The laboratory report forms part of the description of the stone. Weights, dimensions, origins and treatment statements are taken from those reports and from our own examination. Photographs and videos are made with care, yet colour may vary between screens and lighting conditions. The stone itself and its report are the reference.

5. Investment Information

Some pages describe how gemstones have performed as an asset class. This information is provided for general interest only. HLH is a gemstone merchant, not a licensed investment adviser, and nothing on this website constitutes financial, investment, tax or legal advice. Past performance is no guarantee of future value. Gemstone prices can fall as well as rise, and resale can take time. Please seek independent professional advice before purchasing a stone as an investment.

6. Shipping, Insurance and Import

Stones can be delivered worldwide by insured courier, or collected in person in Hong Kong. Shipping terms, insurance and risk of loss are set out in the sale agreement. You are responsible for any import duties, taxes or permits required in the destination country unless the agreement states otherwise. HLH complies with applicable export controls and sanctions.

7. Returns

Because each stone is unique and sold with an independent report, returns are accepted only where agreed in writing in the sale agreement, or where required by applicable law.

8. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree that you will:

• Provide accurate and complete information when making an enquiry.

• Refrain from attempting to gain unauthorised access to any part of the Services.

• Refrain from copying, scraping, reproducing or exploiting website content, photographs or videos without written permission.

• Refrain from interfering with the security, integrity or performance of the Services.

9. Intellectual Property

The Services, including all text, photographs, videos, laboratory report reproductions, branding, logos and designs, are owned by HLH or its licensors and are protected by copyright, trade mark and other intellectual property laws. You may view and print content for your personal, non-commercial use only.

10. Third-Party Links and Services

The Services may link to third-party websites, including laboratory report verification pages and online viewing tools. HLH does not control those websites and accepts no responsibility for their content or practices.

11. Disclaimer

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, HLH makes no warranties about the availability, accuracy or completeness of the website. Warranties relating to a stone you purchase are set out in the sale agreement and the laboratory report.

12. Limitation of Liability

To the fullest extent permitted by law, HLH will not be liable for any indirect, incidental, consequential or special loss arising from your use of the website. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law.

13. Anti-Money Laundering and Compliance

HLH is a dealer in precious stones and complies with the anti-money laundering and counter-terrorist financing requirements applicable in Hong Kong. For certain transactions we will ask you to provide identification documents and information on the source of funds before a sale can be completed.

14. Changes to These Terms

HLH may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Continued use of the Services after a change means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Hong Kong.
